Judge grants summary judgment for client

In an order dated April 8, 2010, Federal Judge Adalberto Jordan entered summary judgment in an FLSA case finding that the employer, a construction company, purchased its materials that were manufactured out-of-state from local stores for use on local projects in Miami-Dade County. Accordingly, employees did not participate in the movement of persons or things in interstate commerce and thus there was no enterprise coverage. The employees were not entitled to overtime.
